In compliance with the General Law of Data Protection, MKS Law presents below its Privacy Policy, ensuring to the Users of our website the respect and due care of their personal data.

WHO IS RESPONSIBLE FOR THE TREATMENT OF THE COLLECTED DATA?

WHAT IS THE DATA COLLECTED BY MKS LAW?

A personal data is any information related to a natural person that allows to identify him/her.

The purpose of this collection of personal data by MKS Law is to identify the context in which the User of our website is inserted so that our services can be provided to you in the best possible way.

The information will be provided by you, voluntarily, when you register on our website and landing pages, by filling out the forms to download our free content and subscribe to our newsletter. Information may also be collected from you through other reputable sources.

WHAT WILL THE DATA BE USED FOR?

Your personal data will be used for purposes related to the use of our website, or to establish a relationship with you, through informative, educational content or to send invitations, offers of events and courses related to the areas of expertise of MKS Law. Such communications may be sent via e-mail, WhatsApp, Telegram, or any other platform suitable for the communication in question.

The e-mail addresses that are collected, if you choose to receive contents, will be used to send weekly newsletters, and some e-mails to send invitations, offers for events and courses related to MKS Law’s practice areas, on an occasional basis.

(ii) “Public authorities”: administrative and judicial authorities that, in the exercise of their competence, require information, even if there is no executive or judicial order or summons to that effect, for the following purposes: (a) to ensure the application or administration of justice, the recognition, exercise or defense of a right in a judicial or administrative proceeding and/or the resolution of disputes; and (b) to comply with any applicable law, regulation or legal provision, or any duly grounded and motivated mandate from a competent authority.

 

In case MKS Law decides to share your personal data with third parties other than those mentioned herein, your prior and express consent will be requested, provided that there is no authorization or legal obligation allowing it to be performed without such consent.

Likewise, you give your express and informed consent for MKS Law to collect, process, and share your personal data with the recipients described in this Privacy Policy.

Finally, MKS Law will not be responsible for the misuse of your personal data by third parties if such third parties have directly collected and/or processed your personal data, without the intermediation of MKS Law.

HOW LONG IS THE DATA STORED?

Your personal data is to be stored for at least as long as necessary to fulfill the purpose for which it was collected, meet legal or regulatory requirements, or during the statute of limitations for possible legal or contractual liabilities. After these periods, some given data might remain stored in order for you to be served with more efficiency and quality in the future.

The data will be stored with all the necessary guarantees to avoid unauthorized access or situations of illegal or accidental loss, alteration or disclosure.

CANCELLATION, CHANGE/DELETION OF PERSONAL INFORMATION

You can choose not to receive any further emails from MKS Law.

In every e-mail sent to you, there is always a link to unsubscribe available in the last lines. Clicking on that link will automatically unsubscribe you from our list.

It is important to mention that filling out any form again will characterize the reinsertion of your e-mail to the list. Therefore, a new unsubscription request should be made if it is of your interest.

All data collected will be deleted or changed when you request either by clicking on the unsubscribe link that will appear in all free content emails, newsletters, invitations to events and courses sent by MKS Law, or by sending an email to this effect to financeiro@mkslaw.com.br.

WHAT ARE YOUR RIGHTS REGARDING THE DATA PROVIDED?

At any time, you may exercise your rights to

– Confirm that MKS Law is handling your personal data in the manner set out in this Privacy Policy;

– Have access to it;

– Request the correction of incomplete, inaccurate or outdated data;

If you are interested in joining our team, you can submit your resume through our site or by e-mail. Your data will be used to enable your participation in our selection processes and may be shared with companies specialized in recruiting and selecting candidates. If you are not selected, your data will be eliminated after the end of the selection process.

IMAGE RIGHTS

The images published in our free content materials, website and social networks are the exclusive property of MKS Law and cannot be reproduced and/or retransmitted by third parties. The reproduction or disclosure, total or partial, of the images may generate to the infringer the duty to indemnify MKS Law and the people identified in them.

MODIFICATIONS ON OUR PRIVACY POLICY

APPLICABLE LAW

This document shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. The District Court of São Paulo, São Paulo, is hereby elected as the competent jurisdiction to settle any issues that may arise from this document, expressly waiving any other, no matter how privileged it may be.
